By accessing or using this website (thespareware.com), you agree to the following Terms of Use between you and Spare Ware Designs LLC (“Spare Ware,” “we,” or “us”).

This website and its content are provided for informational and shopping purposes only. You agree not to misuse, interfere with, attempt to disrupt, or gain unauthorized access to the site, its services, or its security features.

2. Eligibility

By using this site, you represent that you are at least 18 years of age or accessing the site under the supervision of a parent or legal guardian.

3. Intellectual Property

All designs, logos, imagery, text, trademarks, and other content appearing on this site are owned by or licensed to Spare Ware Designs LLC and are protected by copyright and trademark laws. You may not copy, reproduce, distribute, modify, or use any content without prior written permission.

4. Product Information, Availability, and Fulfillment

We make reasonable efforts to display product descriptions, pricing, imagery, and availability accurately. However, we do not guarantee that all information is error-free, complete, or current. Product availability, specifications, pricing, and fulfillment timelines are subject to change without notice. Shipping timelines may vary by product. Please refer to individual product pages for the most accurate fulfillment information prior to placing your order.

5. Orders, Shipping, and Returns

All purchases made through this site are subject to our posted Shipping, Returns, Warranty, and FAQ policies, which are incorporated into these Terms by reference. Once an order is marked as delivered by the carrier, Spare Ware is not responsible for lost or stolen packages, as outlined in our Shipping Policy.

This website may contain links to or integrations with third-party services, including website hosting, analytics, and payment processors. Spare Ware is not responsible for the content, policies, or practices of any third-party websites or services.

7. Disclaimer of Warranties

To the fullest extent permitted by law, Spare Ware Designs, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use this website, its content, or products purchased through the site.

You agree to indemnify and hold harmless Spare Ware Designs, LLC from any claims, damages, losses, liabilities, or expenses arising from your violation of these Terms or misuse of the website.

We reserve the right to update these Terms of Service at any time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.

International Orders

These International Terms apply to orders shipped to Canada. We do not ship to other countries at this time. They govern all such purchases made from SPARE/WARE. By placing an international order, you ("Customer") agree to be bound by them in full.

1. Payment & Order Acceptance

Full payment is required prior to order processing, production (if applicable), and shipment. Submission of payment constitutes acceptance of these Terms.

SPARE/WARE reserves the right to refuse, cancel, or limit any order at its sole discretion, including but not limited to suspected fraud, pricing errors, or inventory issues.

2. Pricing & Currency

Orders shipped to Canada are priced and charged in Canadian dollars (CAD). The Customer is responsible for any foreign transaction fees or additional charges imposed by their financial institution or payment provider.

3. Shipping Costs & Fulfillment

All shipping costs are the responsibility of the Customer and will be clearly presented at checkout or invoicing.

Shipping timelines are estimates only and are not guaranteed. SPARE/WARE is not responsible for delays once an order has been transferred to the shipping carrier.

4. Address Accuracy & Confirmation

The Customer is solely responsible for providing a complete and accurate shipping address, including recipient name, street address, postal code, and country.

By completing a purchase, the Customer confirms that the shipping information provided is accurate. SPARE/WARE is not responsible for lost, delayed, or misdelivered shipments due to incorrect or incomplete address information.

Any costs associated with address corrections, reshipment, or loss due to incorrect information are the responsibility of the Customer.

5. Customs Declarations

All international shipments will be declared accurately in accordance with applicable customs laws and regulations. The declared value will reflect the actual purchase price of the goods.

SPARE/WARE will not alter, undervalue, or misrepresent shipment contents or value under any circumstance.

6. Customs Duties, Import Taxes & VAT

For orders shipped to Canada, customs duties and GST/HST are calculated and collected at checkout, so the Customer is not billed again on delivery. If any other destination charge still applies, such as a provincial fee or a carrier brokerage fee, the Customer is responsible for it.

Failure to pay required charges may result in delays, refusal, or return of the shipment.

7. Delivery Timelines & Customs Delays

Delivery timelines may vary due to customs clearance, carrier processing, weather conditions, geopolitical events, or other factors outside of SPARE/WARE’s control.

SPARE/WARE is not liable for delays caused by customs authorities or third-party carriers.

8. Refused, Unclaimed, or Returned Shipments

If a shipment is refused, unclaimed, abandoned, or returned due to unpaid duties/taxes, incorrect address information, or failure to accept delivery: the Customer is responsible for all return shipping costs and associated fees; original shipping fees are non-refundable; and any reshipment will require additional payment.

Refunds, if issued at SPARE/WARE’s sole discretion, will exclude shipping and any incurred fees.

9. Loss, Theft, or Damage in Transit

Once an order has been transferred to the shipping carrier, responsibility for the shipment passes to the carrier.

SPARE/WARE is not liable for loss, theft, or damage during transit. Customers must file claims directly with the shipping carrier. SPARE/WARE may assist with documentation but assumes no liability.

10. Carrier Responsibility

All shipments are handled by third-party carriers. SPARE/WARE is not responsible for carrier delays, delivery failures, service interruptions, or tracking inaccuracies.

11. Product Availability & Order Modifications

SPARE/WARE reserves the right to modify, delay, or cancel orders due to inventory discrepancies, production issues, or operational constraints. In such cases, the Customer will be notified and refunded if applicable.

12. Chargebacks & Payment Disputes

By completing a purchase, the Customer agrees to contact SPARE/WARE directly to resolve any issues prior to initiating a chargeback or payment dispute.

Improper or fraudulent chargebacks may result in denial of future service, recovery of associated fees, and additional action as permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, SPARE/WARE shall not be liable for any indirect, incidental, consequential, or special damages arising from the purchase, shipment, or use of its products.

14. All Sales Final

Orders shipped to Canada are final sale. No returns, refunds, or exchanges will be accepted, except for items that arrive damaged or defective or where required by applicable law.

15. Compliance with Local Laws

The Customer is responsible for ensuring that purchased items comply with all local laws and import regulations of the destination country.

SPARE/WARE is not responsible for items that are restricted, prohibited, or seized by customs authorities.

16. Updates to Terms

SPARE/WARE reserves the right to update or modify these Terms at any time without prior notice. The version in effect at the time of purchase will govern the transaction.
